for the Upgrade of Transmission Pipeline Crossing of the Kootenay River near Shoreacres

O  R  D  E  R

 

WHEREAS:

 

A.      On July 15, 2010, Terasen Gas Inc. (Terasen Gas) applied to the British Columbia Utilities Commission (the Commission), pursuant to sections 45 and 46 of the Utilities Commission Act, for a Certificate of Public Convenience and Necessity (CPCN) to install a natural gas transmission pipeline, using  horizontal directional drilled (HDD) technology, that crosses the Kootenay River near the community of Shoreacres (the Kootenay River Crossing (Shoreacres) Upgrade Project or the Project);

 

B.      By Order C-9-10 dated November 10, 2010, the Commission granted a CPCN to Terasen Gas for the Project;

 

C.      On December 1, 2010, the Commercial Energy Consumers Association of British Columbia (CEC) submitted a Participant Assistance/Cost Award (PACA) application for its participation in the proceeding;

 

D.      By Letter dated December 21, 2010, Terasen Gas commented that it is of the view that the CEC PACA application is not unreasonable;

 

E.       Commission Order G-72-07 established Guidelines for PACA applications;

 

F.    The Commission Panel has reviewed the PACA application and comments from Terasen Gas with regard to the criteria and rates set out in the PACA Guidelines and has concluded that PACA funding should be awarded to CEC in the amount set out in its application.

 


 

NOW THEREFORE the Commission orders as follows:

 

1.       Pursuant to section 118(1) of the Utilities Commission Act, the Commission awards funds in the amount of $5,509.00 to CEC with respect to its participation in the Terasen Gas Kootenay River Crossing (Shoreacres) CPCN proceeding.

 

2.       Terasen Gas is directed to reimburse CEC for the amount that has been awarded in a timely manner.
