An Application to Cease Registration

for certain functions required for Compliance

with Mandatory Reliability Standards in British Columbia

O  R  D  E  R

 

WHEREAS:

 

A.      Section 125.2 of the Utilities Commission Act (UCA) assigns exclusive jurisdiction to determine whether a “reliability standard,” as defined in the UCA, is in the public interest and should be adopted in British Columbia by the British Columbia Utilities Commission (Commission);

 

B.      Order G-123-09 approves the Rules of Procedure including Registration Manual and Compliance Monitoring Program for entities subject to adopted Mandatory Reliability Standards and requires that entities subject to reliability standards register with the Commission;

 

C.      The Registration Manual requires that the Western Electricity Coordinating Council (WECC), in its role as the Commission’s Administrator for the BC Mandatory Reliability Standards Program (BC MRS Program), review and recommend registration for all Applicable Entities and allows 21 days for Applicable Entities to comment to the Commission on WECC’s recommendations;

 

D.      Commission Order G-140-10 registers Catalyst Paper Elk Falls (Elk Falls) for the functions of Distribution Provider, Load-Serving-Entity, Transmission Owner and Transmission Operator with the BC MRS Program;

 

E.       In a letter dated June 9, 2014, WECC informs the Commission of the transfer in ownership of the Elk Falls facilities to 0942069 BC Ltd., a subsidiary of Quicksilver Resources.  WECC notes that the Elk Falls facilities has been de-energized and decommissioned;

 

F.       In the same letter, WECC recommends Elk Falls cease to be registered as Distribution Provider, Load-Serving-Entity, Transmission Owner and Transmission Operator with the BC MRS Program and recommends no registration for 0942069 BC Ltd.;

 

G.     The Commission considers WECC’s recommendations to cease registration of Elk Falls for the functions listed above and to not register 0942069 BC Ltd. with the BC MRS Program are warranted.

 

 

NOW THEREFORE pursuant to section 125.2(10) of the Utilities Commission Act and in accordance with the Rules of Procedure and Registration Manual, the Commission orders the following:

 

1.       Catalyst Paper Elk Falls ceases to be registered for the functions of Distribution Provider, Load-Serving-Entity, Transmission Owner and Transmission Operator with the British Columbia Mandatory Reliability Standards Program as recommended by the Western Electricity Coordinating Council.

 

2.       The entity 0942069 BC Ltd., a subsidiary of Quicksilver Resources, is required to register with the British Columbia Utilities Commission at such time it becomes subject to reliability standards in accordance with the Mandatory Reliability Standards Program in British Columbia.
