Confirmation of Alleged Violation of Mandatory Reliability Standards PER-002-0 R4 and PER-003-0 R1

O R D E R
WHEREAS:
A. British Columbia Utilities Commission (Commission) Order G-123-09 approved the Compliance Monitoring Program (CMP) which provides a process for dealing with violations to Mandatory Reliability Standards adopted by the Commission;
B. On February 15, 2011, the Western Electricity Coordinating Council (WECC), acting as the Commission’s MRS Administrator, issued a Notice of Alleged Violation to Bear Mountain Wind Limited (BMWL) for standards PER-002-0, Requirement 4 and PER-003-0, Requirement 1 beginning on November 1, 2011 pursuant to section 4.1 of the CMP;
C. On March 9, 2011, BMWL requested a 90-day extension to the allowable reply period provided in the CMP;
D. On April 14, 2011, the Commission allowed BMWL an extension for its reply to June 7, 2011;
E. On June 3, 2011, BMWL filed a mitigation plan with the Commission and the Administrator for the notified violations;
NOW THEREFORE pursuant to section 125.2 of the Utilities Commission Act and section 4.1 of the Compliance Monitoring Program:
1. The Commission confirms the alleged violations of PER-002-0, Requirement 4 and PER-003-0, Requirement 1 for BMWL beginning on November 1, 2010 and continuing until the completion of an approved mitigation plan.
2. At a date yet to be determined, the Commission will initiate a process leading to the determination of the severity of the violation.
