Confirmation of Alleged Violation of Mandatory Reliability Standards

PRC-005-1 R1 and PRC-008-0 R1 and R2

O  R  D  E  R

 

WHEREAS:

 

A.    Order G-123-09 approved the Compliance Monitoring Program (CMP) which provides a process for dealing with violations to Mandatory Reliability Standards adopted by the Commission;

 

B.      On June 10, 2011, the Western Electricity Coordinating Council, acting as the Commission’s MRS Administrator issued a Notice of Alleged Violation to Catalyst Paper Powell River Division (CPPR) for standards PRC-005-1 R1 and PRC-008-0 R1 and R2 beginning on November 1, 2010 pursuant to section 4.1 of the CMP;

 

C.      On December 24, 2010, CPPR filed mitigation plans for the alleged violations which were subsequently approved by Order G-49-11;

 

D.      On August 10, 2011, the Administrator notified CPPR that the matter of the alleged violations were before the Commission and noted that CPPR advised them that they did not intend to file a formal response.

 

 

NOW THEREFORE pursuant to section 125.2 of the Utilities Commission Act and section 4.1 of the Compliance Monitoring Program, the Commission orders as follows:

 

1.       The Commission confirms the alleged violations of PRC-005-1 R1 and PRC-008-0 R1 and R2 for CPPR beginning on November 1, 2010 and continuing until the completion of an approved mitigation plan.


 

 

2.       At a date yet to be determined, the Commission may initiate a process leading to the determination of the severity of the violations.
