O R D E R
WHEREAS:
A. On August 26, 2010, the British Columbia Utilities Commission (Commission), by Letter L-62-10, accepted for FortisBC Energy Inc. (FortisBC Energy) (formerly Terasen Gas Inc.) the 2010/11 Annual Gas Contracting Plan;
B. On July 19, 2011, FortisBC Energy filed with the Commission a fully executed copy of a GasEDI Base Contract with amendments called, “Standard Provisions of the GasEDI contract for Short Term Sale and Purchase of Natural Gas General Terms and Conditions” negotiated between FortisBC Energy and TransAlta Energy Marketing Corp.;
C. FortisBC Energy uses the GasEDI Base Contract dated October 26, 2000 for natural gas contracting. The Special Provisions for each gas transaction is confirmed via a deal sheet described in section 9 of the GasEDI Standard Contract;
D. FortisBC Energy has requested that the details of the subject filing be kept confidential for the reasons of commercial sensitivity set out in the filing;
E. The Commission has reviewed the FortisBC Energy filing and is satisfied that the Special Provisions to the GasEDI Base Contract for Short Term Sale and Purchase of Natural Gas between FortisBC Energy and TransAlta Energy Marketing Corp. is consistent with the Annual Gas Contracting Plan.
NOW THEREFORE pursuant to section 71 of the Utilities Commission Act and the Commission’s Rules for Natural Gas Energy Supply Contracts, the Commission accepts for filing the executed copy of the Special Provisions of the GasEDI Base Contract negotiated between FortisBC Energy Inc. and TransAlta Energy Marketing Corp. for the Short Term Sale and Purchase of Natural Gas. The Commission will keep confidential the TransAlta Energy Marketing Corp. Agreement identified in this Order.
