O R D E R

 

WHEREAS:

 

A.    On October 4, 2010, British Columbia Hydro and Power Authority (BC Hydro) filed its Customer Baseline Load F2010 and F2011 Application (the F10/F11 Application) with the British Columbia Utilities Commission (the Commission) requesting approvals of Final Adjusted F2010 Customer Baseline Loads (CBLs), Interim F2011 CBLs, the placement or continuation of certain customers on Rate Schedule 1823A during F2010 and F2011, and the continuance of Interim F2010 CBLs for two specific customers with unique circumstances;

 

B.    In the F10/F11 Application BC Hydro stated it had submitted all F2010 and F2011 CBLs to customers for review and comment;

 

C.    On November 25, 2010, the Commission issued Order G-176-10, and Letter L-94-10, directing BC Hydro to provide a copy of the Order and Letter to all Transmission Service Rate customers taking service under Rate Schedule 1823 by December 3, 2010.  Customers were requested to provide the Commission with comment on BC Hydro’s proposed CBLs by December 17, 2010.  If a customer had not responded to the Commission by that date, L-94-10 indicated that the Commission would conclude that the customer agreed with the CBLs proposed by BC Hydro;

 

D.    By December 17, 2010, the Commission received comment from Prince Rupert Port Authority (PRPA) concerning the revised CBLs proposed by BC Hydro;

 

E.    On January 10, 2011, BC Hydro filed an Amendment to the F10/F11 Application that indicated, inter alia, that BC Hydro was unable to reach agreement with PRPA on its Interim F2011 CBL;

 

G.    On February 24, 2011, the Commission issued Order G-32-11 initiating a written hearing process for the CBL dispute between PRPA and BC Hydro;

 

H.    On March 3, 2011, BC Hydro filed a second Amendment to the F10/F11 Application that contained updated F2010 and F2011 CBLs;

 

I.     On March 10, 2011, the Commission issued Order G-44-11 which approved the March 3, 2011 Amendment to the F10/F11 Application including a Final Adjusted F2010 CBL for PRPA.  Order G-44-11 did not approve an Interim F2011 CBL for PRPA pending a Commission determination in the CBL dispute written hearing process;

 

J.     On March 16, 2011 PRPA withdrew its CBL dispute from the Commission;

 

K.    On April 1, 2011, BC Hydro filed a letter seeking approval of PRPA’s Interim F2011 CBL as contained in the March 3, 2011 Amendment to the F10/F11 Application.

 

 

NOW THEREFORE the Commission orders the Interim F2011 Customer Baseline Load for Prince Rupert Port Authority, as identified in the column “Interim F2011 CBL for Interim Approval” in Appendix A of the Amendment to the F2010/F2011 CBL Application dated March 3, 2011, is approved on an interim basis until such time as it is approved on a permanent basis by the Commission.
