An Application by FortisBC Energy Inc.

for Approval of an Amending Agreement to a Firm Transportation Service Agreement

between FortisBC Energy Inc. and Westcoast Energy Inc.

O  R  D  E  R

WHEREAS:

A.      On April 13, 2010, the British Columbia Utilities Commission (Commission) issued Order G-70-10 approving an agreement, pursuant to sections 60 and 61 of the Utilities Commission Act (the Act), for a Firm Transportation Service Agreement between FortisBC Energy Inc. (FEI) (formerly Terasen Gas Inc.) and Westcoast Energy Inc. effective for a term from May 1, 2010 to April 30, 2012 (the 2010 Agreement), as Tariff Supplement No. I-9, and approving the accounting treatment for revenue under the Agreement;

 

B.      On April 1, 2011, FEI applied, pursuant to sections 60 and 61 of the Act, for an Amending Agreement to the 2010 Agreement, extending the term in Section 3.1 of Clause 4 from April 30, 2012 to October 31, 2014, as well as adding Section 1.5 to Clause 3 and amending Section 16.1 of Clause 5 for administrative efficiencies (the 2011 Amending Agreement);

 

C.      FEI requests Commission approval prior to April 15, 2011, due to the nature of and timelines associated with commercial arrangements;

 

D.      The Commission reviewed the filing and concludes that the 2011 Amending Agreement should be approved.

 

 

NOW THEREFORE pursuant to sections 60 and 61 of the Act, the Commission orders as follows:

 

1.       The Commission approves the 2011 Amending Agreement extending the term from April 30, 2012 to October 31, 2014.

 

 

 

 

2.       FEI is to file the 2011 Amending Agreement as part of Tariff Supplement No. I-9 for Commission endorsement.
