Application for Reconsideration of ILM Decision

 

In response to the British Columbia Utilities Commission (Commission) Letter L-11-11 of March 9, 2011 requesting comments on the reconsideration application submitted by the NNTC/ONA/Upper Nicola, Coldwater et al. and the Stó:lō Tribal Council (STC) filed submissions on March 16, 2011 and March 23, 2011, respectively.  The Coldwater et al. and STC submissions raise a number of new alleged errors on the part of the Commission that were not raised in the NNTC/ONA/Upper Nicola’s application for reconsideration.

 

British Columbia Hydro and Power Authority (BC Hydro) responded to Coldwater et al.’s submission on March 21, 2011 requesting the reconsideration schedule be modified to allow BC Hydro time to respond to Coldwater et al. and any other Interveners who may support NNTC/ONA/Upper Nicola or who may propose new grounds for reconsideration.  NNTC/ONA Upper Nicola responded to BC Hydro on March 22, 2011 requesting the Commission refuse BC Hydro’s request because BC Hydro did not justify its request to modify the Commission’s schedule.  BC Hydro filed its response to Letter L-11-11 on March 23, 2011 reiterating its request for a separate process to respond to Coldwater et al. and the STC.

 

The Commission Panel has reviewed the submissions and considers that in the interest of fully considering the issues involved in reconsideration of the Commission’s decision, BC Hydro, Interveners and Interested Parties should have an opportunity to respond to the Coldwater et al. and STC submissions.

 

BC Hydro, Interveners and Interested Parties are to submit their written comments, if any, on whether or not the new errors alleged by Coldwater et al. and STC meet the threshold requirements for phase one of reconsideration to the Commission by Thursday, March 31, 2011.  Coldwater et al. and STC are to submit their written replies, if any, to the Commission by Thursday, April 14, 2011.  The April 6, 2011 deadline for NNTC/ONA/Upper Nicola to reply to the March 23, 2011 submissions, as set out in Letter L-11-11, remains unchanged.
