O R D E R
WHEREAS:
A. On March 1, 2011, International Forest Products Limited (Interfor) – Adams Lake Lumber Division filed an application (Interfor Application) with the British Columbia Utilities Commission (Commission) requesting an adjustment to the calculation of the Historical Baseline (HBL) under British Columbia Hydro and Power Authority’s (BC Hydro) Large General Service (LGS) rate;
B. Paragraph 13 of the LGS Negotiated Settlement Agreement (NSA), approved by Commission Order G-110-10, allows for customers who anticipate significant, permanent increase in energy consumption, as defined in paragraph 13, to apply to the Commission to seek an increase in their HBLs on a prospective basis;
C. The Interfor Application also requests that the January 1, 2011 implementation of the new LGS rates to be set as Interim and refundable assuming approval of the new Prospective Growth Adjustment by the Commission;
D. The Commission has decided that it would allow the Interfor Application for higher HBL to proceed but will make its determination in a separate order. The Commission has determined that this Order at hand will address the Interfor’s request for Interim rates to be effective as of January 1, 2011.
NOW THEREFORE the Commission orders as follows:
1. The request for Interfor Adams Lake Lumber Division LGS rate to be made interim effective January 1, 2011 is denied.
2. BC Hydro’s LGS rate, as it is applicable solely to Interfor Adam Lake Lumber Division, is interim and refundable effective the date of this Order.
3. BC Hydro will provide a refund to Interfor Adams Lake Lumber Division, if required, when the Commission has issued its order on the Interfor Application for a Prospective Growth Adjustment pursuant to paragraph 13 of the LGS NSA.
