Re:  British Columbia Hydro and Power Authority

Fiscal 2011 Revenue Requirements Application

   Request for Reconsideration of Order F‐13‐11   

 

The British Columbia Utilities Commission (Commission) has reviewed your June 8, 2011 request for review and variance of Commission Order F-13-11 regarding the Applications for Participant Assistance/Cost Award (PACA) in the Application by British Columbia Hydro and Power Authority for the Review of the Fiscal 2011 Revenue Requirements Application (BC Hydro F2011 RRA).  Under section 99 of the Utilities Commission Act, the authority of the Commission to allow are consideration is discretionary.  The Commission’s discretion to reconsider and vary a decision or an order is applied with a view to ensuring that there is consistency and predictability in the Commission’s decision-making.  The Commission generally applies the following criteria to determine whether or not a reasonable basis exists for allowing the reconsideration:

 

  1. the Commission has an error in fact or law;
  2. there has been a fundamental change in circumstances or facts since the Decision;
  3. a basic principle had not been raised in the original proceedings; or
  4. a new principle has arisen as a result of the decision.

 

Your request for reconsideration restated information submitted in your original BC Hydro F2011 RRA PACA application and included no new substantive information.  As a result, none of the criteria to substantiate that a reasonable basis for reconsideration exists has not been met.  Therefore, your request for review and variance of Commission Order F-13-11 is denied.
