CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY

 

WHEREAS:

 

A.      On July 13, 2012, FortisBC Energy Inc. (FEI) applied (the Application) to the British Columbia Utilities Commission (the Commission), pursuant to sections 45 and 46 of the Utilities Commission Act (the Act), for a Certificate of Public Convenience and Necessity for constructing and operating a Liquefied Natural Gas (LNG) refueling station at the premises of Vedder Transport Ltd. (Vedder) located in Abbotsford, British Columbia and pursuant to sections 59-61 of the Act, for a rate design and rates as set out in Section 5 of the Application, as just and reasonable;

 

B.      On August 2, 2012, FEI amended its Application (Amended Application) seeking approval for the rate design and rates on an interim basis pending the resolution of (1) Inquiry regarding FEI’s Offering of Products and Services in Alternative Energy Solutions and Other New Initiatives (AES Inquiry) and (2) FEI’s Application for Variance and Reconsideration of Commission Order C-6-12 regarding Rates for Fueling Service for BFI Canada Inc.;

 

C.      By Order G-114-12, the Commission established a Streamlined Review Process for the review of the Application;

 

D.      The Commission has reviewed the Application and determines that the approvals sought in the Application and Amended Application should be granted.

 

 

NOW THEREFORE, the Commission orders as follows:

 

1.       Pursuant to sections 45 and 46 of the Utilities Commission Act, FEI is granted a Certificate of Public Convenience and Necessity for the construction and operation of a Liquefied Natural Gas refueling station at the premises of Vedder Transport.

 

2.       Pursuant to sections 59-61 of the Utilities Commission Act, the rate design and the rates set out in Section 5 of the Application.
