O R D E R
WHEREAS:
A. On February 3, 2012, Sun Peaks Utilities Co., Ltd. (SPUL) submitted a report providing details regarding efforts to address rising energy supply costs and long term energy supply options;
B. On March 30, 2012, SPUL applied to the British Columbia Utilities Commission (Commission) for acceptance of a propane supply agreement dated March 19, 2012, between MP Energy Partnership (MP Energy) and FortisBC Alternative Energy Services Inc. (FAES) to supply SPUL with propane for the period from April 1, 2012 to March 31, 2014 (the Agreement);
C. The Agreement provides the opportunity to implement a price hedging strategy for a portion of SPUL’s winter propane supply;
D. SPUL has requested that the Agreement and associated documents remain confidential due to their commercially sensitive nature;
E. The Commission has reviewed the SPUL submission and has determined that the Agreement is appropriate and in the public interest.
NOW THEREFORE pursuant to section 71 of the of the Utilities Commission Act, the Commission accepts for filing the executed copy of the Agreement between FAES and MP Energy for the supply of propane to SPUL and requests that SPUL file a report with the Commission by November 1, 2012 and November 1, 2013, providing details of the propane price paid for the hedged component of the respective upcoming winter propane supply. The Commission will keep confidential the Agreement and associated documents identified in this Order.
