O R D E R
WHEREAS:
A. On November 9, 2012, Pacific Northern Gas (N.E.) Ltd. (PNG (N.E.)) filed a confidential application (Application) to the British Columbia Utilities Commission (Commission) under section 39 of the Utilities Commission Act (the Act) to enter into the Quintette Mine Security of Supply Agreement for a three month period over the winter of 2012/2013;
B. On November 22, 2012 PNG (N.E.) filed an amended non-confidential version of the Application (Amended Application) and its response to the Commission Confidential Information Request No. 1 (IR Response);
C. The Commission has reviewed the Amended Application, IR Response and supporting material and finds that the requested approvals are in the public interest.
NOW THEREFORE pursuant to section 39 of the Utilities Commission Act the Commission orders as follows:
1. The Amended Application by PNG (N.E.) to (i) enter into the Quintette Mine Security of Supply Agreement, (ii) setup the required deferral accounts as requested, and (iii) cause to undertake the necessary arrangements to ensure the supplemental gas supply can be delivered on a timely basis during the contract term is approved.
2. PNG (N.E.) is directed to include proposed treatment for the deferral account established under this Order in its next Revenue Requirements application. PNG (N.E.) is directed to inform the Commission immediately of any significant departure in the terms and conditions set forth in the Quintette Security of Supply Agreement.
