O R D E R
WHEREAS:
A. On August 30, 2012, FortisBC Alternative Energy Services Inc. (FAES) filed an application with the British Columbia Utilities Commission (Commission) seeking approval for a Certificate of Public Convenience and Necessity (CPCN) pursuant to sections 45 and 46 of the Utilities Commission Act (Act) to construct and operate the Kelowna District Energy System (KDES), which will provide thermal energy service for heating buildings in the Kelowna City Centre and for approval of the rate design and rates that will be used to recover the cost of service from customers of the KDES (the Application);
B. By Order G-123-12 dated September 13, 2012, the Commission established a Written Hearing Process and a Regulatory Timetable for the review of the Application;
C. On September 21, 2012, FAES filed a letter with the Commission to request approval to withdraw the Application. FAES explained that after discussions with Commission Staff, FAES understands the Application should address more comprehensively the CPCN Guidelines. FAES has determined this course of action would provide the most efficient regulatory review of the Application;
D. FAES intends to prepare a revised Application for submission to the Commission in due course, which will include a proposed Regulatory Timetable.
NOW THEREFORE the Commission orders as follows:
1. The Commission approves FAES’ request to withdraw the Application and therefore the closing of the Proceeding.
2 FAES shall advise the relevant parties of the withdrawal of the Application.
