regarding Rate Schedule 14A for the 2012/13 Gas Contract Year

O R D E R

 

WHEREAS:

 

A.      By Order G-88-11, the British Columbia Utilities Commission (Commission) approved for FortisBC Energy Inc. (FEI) (then Terasen Gas Inc.) market-based commodity rates for the 2011/12 gas contract year;

 

B.      In Order G-88-11, the Commission ordered that in the event FEI applies in the future to continue Rate Schedule 14A beyond the 2011/12 gas contract year, it will address whether the Rate Schedule should be approved in a form that permits it to continue in effect from year to year;

 

C.      On August 16, 2012, FEI filed an application regarding Rate Schedule 14A (Application) for approval of the continuation of market-based commodity rates and the continuation of Rate Schedule 14A tariff in a form that permits it to continue to be in effect from year to year without the requirement to file an annual Application;

 

D.      On October 12, 2012, FEI filed further revisions to the proposed Rate Schedule 14A tariff (Revised Rate Schedule 14A Tariff) in response to comments raised by Commission staff;

 

E.       The Commission has considered the Application as revised in the October 12, 2012 filing and is satisfied that the Revised Rate Schedule 14A should be approved.

 

 

NOW THEREFORE the Commission orders as follows:

 

1.       The Commission approves the continuation of Rate Schedule 14A on a permanent basis as proposed in the Application and approves the Revised Rate Schedule 14A Tariff.

 

2.       The Commission review of Rate Schedule 14A going forward will be on a complaints basis and, as such, the Commission will consider reopening the review of Rate Schedule 14A in the event a marketer or customer expresses concerns.

 

3.       The Commission will accept, subject to timely filing, Gas Tariff Rate Schedules in accordance with this Order.

 

4.       FEI will provide a copy of this Order to all current customers of Rate Schedule 14A.

 

5.       FEI will continue to file a report for Rate Schedule 14A within 30 days of the end of each gas contract year that summarizes monthly gas purchase and sales quantities, and costs and revenue for each month.
