Energy Tariff

O R D E R
WHEREAS:
A. On December 19, 2011, by Order C-14-11 and accompanying Decision the British Columbia Utilities Commission (Commission) granted River District Energy Limited Partnership (RDE) a Certificate of Public Convenience and Necessity (CPCN) for the construction and operation of a District Energy Utility for the River District development under sections 45 and 46 of the Utilities Commission Act (Act);
B. On January 12, 2012, by Order G-2-12 the Commission approved the energy rates that RDE could charge for the period of 2012 through 2016. Directive 3 of that Order required RDE to file a tariff including terms and conditions for its provision of energy services to customers;
C. On March 5, 2012, RDE filed tariff pages which were accepted by Commission letter dated March 19, 2012. The Commission subsequently found that the tariff pages were accepted in error since the tariff pages included specific terms and conditions as well as proposed charges that were not approved by Orders C‑14‑11 or G-2-12;
D. By Commission letter dated November 13, 2012, RDE was instructed to re-file tariff pages and mark any existing tariff pages as “invalid”;
E. On November 30, 2012, RDE re-submitted its tariff for acceptance by the Commission;
F. On December 11, 2012, RDE re-submitted its tariff with minor corrections;
G. The Commission has reviewed the re-submitted tariff pages and finds they should be accepted.
NOW THEREFORE pursuant to section 61 of the Utilities Commission Act;
1. The Commission approves RDE’s tariff as filed.
