O  R  D  E  R

 

WHEREAS:

 

A.       On November 27, 2009 the British Columbia Utilities Commission (Commission) issued Letter L-106-09 asking British Columbia Hydro and Power Authority (BC Hydro) to provide draft guidelines for the determination of Generator Baselines (GBL);

B.       On June 20, 2012, BC Hydro submitted an Information Report which, among other things set out certain principles related to GBL establishment, and GBL establishment considerations for Energy Purchase Agreement (EPA) customers;

C.       On November 2, 2012 BC Hydro filed an Application with the Commission under sections 58-61 of the Utilities Commission Act to Amend Tariff Supplement No. 74 (TS No. 74) effective April 1, 2013 (the Application);

D.       The Application seeks approval for the addition of Attachment B Guidelines (the Proposed Guidelines) to TS No. 74.  The Proposed Guidelines address the determination, adjustment and reset of the Customer Baseline Load (CBL) for Rate Schedule 1823 customers with electrical power self-generation facilities which are installed at the same site as the customer’s plant, on the customer’s side of the point of delivery, and which are used to supply a portion of the customer’s load;

E.        The Application also seeks approval for associated amendments to the body of TS No. 74 to delete which content and/or references to CBL-related treatments are contained in the Proposed Guidelines;

F.        BC Hydro states that it undertook consultation with Transmission Service Rate (TSR) customers and the Association of Major Power Consumers (AMPC) on the proposed changes, including holding workshops and tariff reviews, which continued through October 2012.  In addition, BC Hydro held a Pre-filing Workshop on October 12, 2012 which was attended by AMPC, TSR customers, Commission staff and several other interested parties;

G.       BC Hydro proposed that the Application be heard by way of a Written Hearing Process with a Regulatory Timetable that contemplated one round of Commission and Intervener Information Requests (IRs);

H.       The Commission has reviewed BC Hydro’s proposed Regulatory Timetable and considers a Preliminary Regulatory Timetable should be established for the registration of Interveners and Interested Parties, one round of Commission and Intervener IRs and BC Hydro’s responses to those IRs.  The Commission will issue a further regulatory order to establish the remaining process in due course.

 

 

NOW THEREFORE the Commission orders as follows:

1.       The Preliminary Regulatory Timetable for the Application is as set out in Appendix A to this Order.  The remaining dates and events after January 18, 2013, are subject to further Order.

 

2.       BC Hydro is to provide a copy of this Commission Order, the Initial Regulatory Timetable attached as Appendix A to this Order and the Information Report to all Transmission Service Rate Customers and all parties copied on the Application.

 

3.       The Application, together with any supporting materials, will be made available for inspection at the following locations:

4.       BC Hydro will make the Application available on its website at http://www.bchydro.com.

 

5.       Interveners and Interested Parties should register with the Commission, in writing or by electronic submission, by Monday, December 10, 2012.
