Re: FortisBC Energy Inc.

Application for a Certificate of Public Convenience and Necessity

for Constructing and Operating a Compressed Natural Gas Refuelling Station at BFI Canada (BFI);

British Columbia Utilities Commission Order C-6-12 dated April 30, 2012 Compliance Filing; and

Application for Variance and Reconsideration and Revised Application for Rates for Fuelling Service for BFI

On June 16, 2012, FortisBC Energy Inc. (FEI) submitted an Application for Variance and Reconsideration and Revised Application for Rates for Fuelling Services for BFI (Reconsideration Application).  As the first phase of the two-phase reconsideration process, the British Columbia Utilities Commission (Commission) requested submissions on the following:

         Should there be a reconsideration by the Commission?

If there is to be a reconsideration:

         Should the Commission hear new evidence and should new parties be given the opportunity to present evidence?

         Should it focus on the items from the Reconsideration Application, a subset of these items, or additional items?

         What process should be established for the reconsideration?

The Commission received responses from the BC Sustainable Energy Association on July 4, 2012 and the British Columbia Old Age Pensioners’ Organization on July 5, 2012.  FEI provided its reply submission on July 11, 2012.

The Commission finds that FEI has established a prima facie case to warrant proceeding to Phase 2 of the Reconsideration.  In the unusual circumstances of this case, where there is some potential overlap with issues relevant to the Alternative Energy Solutions Inquiry (AES Inquiry), the Commission Panel invites Interveners who are registered in the AES Inquiry to register for Phase 2 of the Reconsideration, if interested, by July 30, 2012.

                                                                                                                                Sincerely,
