O  R  D  E  R

WHEREAS:

 

A.      Section 125.2 of the Utilities Commission Act (Act) assigns exclusive jurisdiction to determine whether a “reliability standard,” as defined in the Act, is in the public interest and should be adopted in British Columbia by the British Columbia Utilities Commission (Commission).  By Order G-123-09 the Commission approved the Compliance Monitoring Program (CMP) for monitoring and enforcement of adopted reliability standards and appointed the Western Electricity Coordinating Council (WECC) as its Administrator for registration and monitoring compliance as per section 8 of the Act;

 

B.      Commission Order G-67-09 requires entities subject to approved Mandatory Reliability Standards, to file mitigation plans outlining how they plan to meet compliance with standards they are not in compliance with;

 

C.      Section 5.1.1 of the CMP requires that an entity file a Mitigation Plan for every violation to a standard requirement and that WECC review the Mitigation Plan and make a recommendation to the Commission;

 

D.      On December 14, 2010, Powell River Energy Inc (PREI) submitted a Mitigation Plan to address alleged violations of Reliability Standards FAC-008-1 R1, R2 and R3 with a completion date of August 26, 2011;

 

E.       On December 14, 2010, Powell River Energy Inc (PREI) submitted a Mitigation Plan to address alleged violation of Reliability Standard FAC-009-1 R1 with a completion date of November 11, 2011;

F.       By letter dated January 20, 2012, WECC recommended acceptance of the Mitigation Plans for PREI to bring into compliance the standards listed above.  Shortly thereafter, the Commission was informed that PREI was revising the completion dates for the Mitigation Plan listed above;

 

G.     On January 25, 2012, PREI submitted a revised Mitigation Plan for FAC-008-1 R1.  On January 30, 2012, PREI submitted a revised Mitigation Plan for FAC-008-1 R2 and R3.  On February 2, 2012, PREI submitted a revised Mitigation Plan for FAC-009-1 R1;

 

H.      By letters dated April 12, 2012, WECC recommended acceptance of the following Mitigation Plans for PREI to bring into compliance the following standards:

NOW THEREFORE pursuant to section 125.2 (10) of the Act and in accordance with the Compliance Monitoring Program, the Commission accepts WECC’s recommendations and approves the Mitigation Plans as listed above.
