O  R  D  E  R

WHEREAS:

A.      On October 10, 2013, by Order A-13-13, the British Columbia Utilities Commission (Commission) issued a Gas Marketer Licence extension to Planet Energy (B.C.) Corp. (Planet Energy), for the period November 1, 2013 to December 31, 2013.  Condition ‘e’ of the Licence requires Planet Energy to submit materials to satisfy Licence Requirements 6 and 7, Audited Statements and Financial Qualifications, as set out in Attachment 1 to the Rules for Gas Marketers, to the Commission by November 29, 2013;

B.      On November 19, 2013, Planet Energy applied to the Commission for an extension of the deadline to submit materials to satisfy Licence Requirement 6 from November 29, 2013 to December 31, 2013 (Application);

C.      On November 22, 2013, Planet Energy supplemented the Application by requesting the extension of the deadline to submit materials to satisfy Licence Requirement 7, Financial Qualifications, from November 29, 2013 to December 31, 2013 and the expiry date of their Gas Marketer Licence from December 31, 2013 to January 31, 2014; and

D.      The Commission has reviewed Planet Energy’s Application and finds that approval, subject to certain conditions, is warranted.

NOW THEREFORE pursuant to section 71.1(6) of the Utilities Commission Act, the Commission orders as follows:

1.       The deadline for submitting materials to satisfy Licence Requirements 6 and 7, as set out in condition ‘e’ of Planet Energy’s Licence issued by Order A-13-13, is amended from November 29, 2013 to December 31, 2013.

2.       The term of Planet Energy’s Licence issued by Order A-13-13 is extended from December 31, 2013 to January 31, 2014.

3.       Planet Energy is not permitted to market or enroll new customers for the period January 1, 2014 to January 31, 2014, during which time the Commission will consider whether Planet Energy satisfies Licence Requirements 6 and 7.
