O R D E R
WHEREAS:
A. On July 11, 2013, the British Columbia Utilities Commission (Commission), by Letter L-43-13, accepted the FortisBC Energy Inc. (FEI) 2013/14 Annual Gas Contracting Plan;
B. On July 18, 2013, the Commission, by Letter L-44-13, accepted the FortisBC Energy (Vancouver Island) Inc. (FEVI) 2013/14 Annual Contracting Plan;
C. On November 12, 2013, FEI filed with the Commission an executed copy of the amended Mist Storage Agreement D between Northwest Natural Gas Company and FEI. In addition, FEI filed an agreement to sublease Mist Storage to FEVI (collectively the Filing);
D. FEI has requested that the Filing and associated contracts remain confidential due to their commercially sensitive nature; and
E. The Commission has reviewed the Filing and is satisfied that the gas storage and sublease contracts are in the public interest and should be accepted.
NOW THEREFORE pursuant to Section 71 of the of the Utilities Commission Act and the Commission’s Rules for Natural Gas Energy Supply Contracts:
1. The Commission accepts for filing the two contracts described as follows:
a. The amended Mist Storage Agreement D between Northwest Natural Gas Company and FortisBC Energy Inc. for Firm Interstate Storage Service, Mist Storage Agreement D.
b. The replacement Mist Storage Contract D between FortisBC Energy Inc. and FortisBC Energy (Vancouver Island) Inc.
2. The Commission will keep confidential the Filing and associated contracts identified in this Order.
