O R D E R
WHEREAS:
A. On April 13, 2010, the British Columbia Utilities Commission (Commission) issued Order G-70-10 approving an agreement, pursuant to sections 60 and 61 of the Utilities Commission Act, for a Firm Transportation Service Agreement between FortisBC Energy Inc (FEI) (formerly Terasen Gas Inc.) and Westcoast Energy Inc. (Spectra Energy) effective for a term from May 1, 2010 to April 30, 2012 (2010 Agreement), as Tariff Supplement No. I-9, and approving the accounting treatment for revenue under the agreement;
B. By Order G-69-11, the Commission approved an amendment to the 2010 Agreement extending the term of the Agreement to October 31, 2014 (2011 Amending Agreement);
C. On June 21, 2013, FEI filed pursuant to sections 60 and 61 of the Utilities Commission Act for approval of an amending agreement to the 2010 Agreement (2013 Amending Agreement) to (i) extend the agreement term from October 31, 2014 to October 31, 2016, and (ii) increase the maximum volume available from 2464.5 103m3 (87 MMscfd) to 2577.8 103m3 (91 MMscfd) (Application);
D. The Commission has reviewed the Application and concludes that approval of the 2013 Amending Agreement is reasonable.
NOW THEREFORE pursuant to sections 60 and 61 of the Utilities Commission Act, the British Columbia Utilities Commission orders as follows:
1. The amendments to the Firm Transportation Service Agreement between FortisBC Energy Inc. and Westcoast Energy Inc. (2013 Amending Agreement) are approved.
2. FEI must file the 2013 Amending Agreement, once executed, as part of Tariff Supplement I-9 for Commission endorsement.
