O  R  D  E  R

 

WHEREAS:

 

A.      On November 28, 2013, the Province of British Columbia deposited Order in Council No. 557, dated November 27, 2013, as B.C. Regulation 245/2013, Special Direction No. 5 to the British Columbia Utilities Commission (Commission);

B.      Section 5 (1) of Special Direction No. 5 provides:

5        (1)    Within 20 days of the date this direction comes into force, the commission must do all of the following:

(a)  issue an order setting the LNG rate schedule [Rate Schedule 46] as a rate for FortisBC Energy Inc. effective on the date the order is issued;

(b)  accept for filing under section 71 of the Act the Gas Liquefaction, Storage and Dispensing Service Agreement between FortisBC Energy (Vancouver Island) Inc. and FortisBC Energy Inc. as set out in Appendix 2 attached to this direction;

(c)   issue an order setting the agreement referred to in paragraph (b) as a rate for FortisBC Energy (Vancouver Island) Inc.

C.      On December 4, 2013, FortisBC Energy Inc. (FEI) applied for an Order from the Commission, pursuant to Section 5(1)(a) of Special Direction No. 5 setting Rate Schedule 46 as a rate for FEI (Application); 

D.      As contemplated under Rate Schedule 46, Rate Schedule 46 customers who choose to select a portion of their gas as a percentage of Biomethane will be charged the Biomethane Energy Recovery Charge rate that is approved by the Commission and in effect from time to time;

E.       FEI provided for Commission endorsement, Rate Schedule 46 Tariff pages to be effective the date of issuance of a Commission Order; and

F.       The Commission has reviewed Special Direction No. 5 and the Application and finds that approval of Rate Schedule 46 is required.

 

NOW THEREFORE pursuant to Special Direction No. 5, the Commission orders Rate Schedule 46 – Liquefied Natural Gas Sales, Dispensing and Transportation Service rate schedule and the rates contained therein, are approved effective the date of this Order.
