Dear Mr. Shadrack:

Re:  FortisBC Inc.

Application for a Certificate of Public Convenience and Necessity

for the Advanced Metering Infrastructure (AMI) Project

Leave to File Late Responses to Intervener Evidence Information Requests

By this letter, the British Columbia Utilities Commission grants Area D, Regional District Central Kootenay (RDCK), leave to file responses to Information Requests on your filed evidence after the existing regulatory deadline of February 21, 2013.  RDCK may file its responses up to March 1, 2013 (4:00 p.m. PST) if required due to the extenuating circumstances identified in your email to the Commission dated February 12, 2013 (Exhibit C13-27).

By letter on February 13, 2013, the Commission sought submissions from Interveners and FortisBC Inc on your request for leave.  Five Interveners submitted comments and all supported your request for an extension to file responses with extension deadlines ranging from March 1, 2013 (BCPSO) to allow for review over the weekend prior to the Oral Hearing, to March 11, 2013 (Jerry Flynn).  Three Interveners identified March 4, 2013 (the start of the Oral Hearing) as the latest date for filing.  FortisBC also supported an extension to March 1, 2013.  The Commission finds it reasonable to grant the extension due to the extenuating circumstances and notes the support of all commenting parties.  The Commission finds that a reasonable and fair date to grant the extension, while allowing FortisBC and other parties to review and prepare for the Oral Hearing, is 4:00 p.m. on March 1, 2013, according to the normal filing protocol.

The Commission joins the other Interveners and FortisBC in expressing our sincere wishes to Mr. McLennan for a complete recovery.

                                                                                                                                  Yours truly,
