O  R  D  E  R

WHEREAS:

A.      The British Columbia Hydro and Power Authority (BC Hydro) has supplied electricity to FortisBC Inc. (FortisBC) for 20 years to meet a portion of FortisBC’s load service obligations, pursuant to a Power Purchase Agreement (PPA) dated October 1, 1993 (1993 PPA), at rates established by the British Columbia Utilities Commission (Commission) and set out in BC Hydro Rate Schedule 3808;

B.      The 1993 PPA expires on September 30, 2013 pursuant to Commission Orders G‑27‑93 and G‑85‑93;

C.      On May 24, 2013, BC Hydro filed an Application with the Commission requesting approval of four new agreements between BC Hydro and FortisBC to replace the supply provided under the expiring 1993 PPA, pursuant to sections 58 to 61 of the Utilities Commission Act (Application);

D.      The four new agreements, each dated May 21, 2013, include: a Power Purchase Agreement (New PPA), an Imbalance Agreement, an Energy Export Agreement and a Master Accounting Agreement;

E.       BC Hydro indicated that it will be making a supplementary filing by July 16, 2013 of an amended and restated General Wheeling Agreement between BC Hydro and FortisBC;

F.       BC Hydro provided a proposed regulatory timetable, with FortisBC’s support, that includes two workshops, one round of Commission and Intervener information requests (IRs) and a procedural conference to determine what further regulatory process may be necessary after the response to the IRs have been filed;

G.     On May 27, 2013, FortisBC filed a letter in support of the Application and confirmed its intention to respond to IRs regarding this submission (Exhibit C1-2).

 

NOW THEREFORE the Commission orders as follows:

 

1.       The Initial Regulatory Timetable for the Application is set out in Appendix A to this Order.

 

2.       Two workshops will be held as set out in Appendix B to this Order.

 

3.       The Commission will issue a letter setting the date and providing instructions for the Procedural Conference in due course.

 

4.       Within four business days of issuance, BC Hydro is to provide a copy of this Order, electronically where possible, to the parties attached as Appendix C to this Order.

 

5.       Interveners and Interested Parties are to register with the Commission, in writing or electronically, by June 7, 2013.  Interveners should specifically state the nature of their interest in the Application.

 

6.       The deadline for submitting budgets for Interveners intending to apply for participant assistance will be established after the Procedural Conference; however, the Commission will provide comments on budgets submitted in advance of the deadline.
