O R D E R
WHEREAS:
A. By Letter L-43-13 dated July 11, 2013 the British Columbia Utilities Commission (Commission) accepted the FortisBC Energy Inc. (FEI) 2013/14 Annual Gas Contracting Plan (ACP);
B. On April 24, 2014, FEI filed with the Commission an application for approval of an amendment to the Avista Corporation (Avista) Deferred Exchange Agreement DE1 4 Year Firm Gas Storage Agreement to extend the term a further 2 years (the Amendment);
C. FEI in its filing requests acceptance of the Amendment under section 71 of the Utilities Commission Act;
D. FEI requests that the Amendment and the associated filing remain confidential due to their commercially sensitive nature; and
E. The Commission reviewed the FEI filing and is satisfied that the Amendment between FEI and Avista is consistent with the ACP, is in the public interest and that the filing and Amendment should be kept confidential.
NOW THEREFORE pursuant to section 71 of the of the Utilities Commission Act and the British Columbia Utilities Commission’s Rules for Natural Gas Energy Supply Contracts, the Commission accepts the Amendment between FortisBC Energy Inc. and Avista Corporation. The Commission will keep the Amendment and filing confidential as requested by FEI to protect commercially sensitive information.
