IN THE MATTER OF

An Application by FortisBC Energy Inc.

for Approval of Rate Design and Rates for Constructing and Operating a Compressed Natural Gas Refueling Station under the Province’s Greenhouse Gas Reduction Regulation for For Less Disposal Inc.

O  R  D  E  R

 

WHEREAS:

 

A.      On April 11, 2013, the British Columbia Utilities Commission (Commission) issued Order G-56-13 accepting that the Greenhouse Gas Reduction Regulation (GGRR) established the need for Compressed Natural Gas (CNG) and Liquefied Natural Gas (LNG) fueling stations that are undertaken by FortisBC Energy Inc. (FEI) as prescribed undertakings as defined by the GGRR, and that these prescribed undertaking projects are exempt from the Certification of Public Convenience and Necessity (CPCN) requirements for the term of the GGRR;

B.      On June 1, 2014, FEI and For Less Disposal Inc. (For Less) entered into a Fueling Station Licence and Use Agreement (Agreement) that establishes terms and conditions for FEI’s provision of CNG fueling service (CNG Fueling Service) to For Less;

C.      On July 17, 2014, FEI applied to the Commission, pursuant to sections 59 to 61 of the Utilities Commission Act (UCA), for approval, as a prescribed undertaking under the GGRR, of the rate design and rates established in the For Less Agreement (Application);

D.      On July 31, 2014, the Commission issued Information Requests No. 1 (IR 1) to FEI, and FEI responded on August 15, 2014; and

E.       The Commission has reviewed and considered the Application, including the responses to IR 1, and determines the rate design and rates should be approved.


 

 

 

NOW THEREFORE pursuant to sections 59 to 61 of the Utilities Commission Act, the Commission orders as follows:

1.       The rate design and rates established in the Agreement with For Less Disposal Inc. for the CNG Fueling Service are approved effective the in-service date. 

 

2.       FortisBC Energy Inc. is to file the For Less Agreement, and the required Amending Agreement, in tariff supplement form on a timely basis for endorsement by the Commission.
