IN THE MATTER OF
the Utilities Commission Act, R.S.B.C. 1996, Chapter 473
and
British Columbia Hydro and Power Authority
Application
for Approval of Changes
Related to Meter Choices Program
BEFORE: L.F. Kelsey, Panel Chair
D.M. Morton, Commissioner February 6, 2014
N.E. MacMurchy, Commissioner
O R D E R
WHEREAS:
A. By letter dated February 1, 2014, Registered Intervener, Mr. John Hurd, applied for reconsideration of Order G-186-13 and the Commission decision related to approving BC Hydro’s interim fees for Legacy and Radio‑off Meters (Reconsideration Application);
B. By Commission Letter L-9-14, the Commission initiated Phase I of the two-phase process for the Reconsideration Application. All parties were invited to comment according to the following timetable:
i. All parties to file their comments by Tuesday, February 11, 2014, and
ii. Mr. Hurd may respond to Participants’ comments by Friday, February 14, 2014;
C. By letter dated February 5, 2014, Registered Intervener Mr. Andy Shadrack, on behalf of Area D, RDCK, requested either (i) an amendment to the February 7, 2014 Intervener Final Submission deadline date; or in the alternative, (ii) seven working days from February 7, to provide comments to the Reconsideration Application;
D. The Commission Panel has reviewed Mr. Shadrack’s request and considers that:
a. Intervener Final Submissions in the current proceeding address the setting of permanent fees whereas Participants’ comments on the Reconsideration Application Phase I address the setting of interim fees and these are two separate processes and as such, are not related; and
b. the Commission agrees that Interveners may benefit from more time to prepare their comments in the Reconsideration Application.
NOW THEREFORE the Commission determines that:
1. The Amended Regulatory Timetable setting the Final Submission and Reply Submission as determined in Appendix B that is attached to Order G-186-13 will not be revised.
2. Mr. Shadrack’s request for delay in the deadline for comments on the Reconsideration application is granted in part. Participants are to file their comments with the Commission by Friday, February 14 and Mr. Hurd is to file his reply, if any, by Thursday, February 20.
DATED at the City of Vancouver, in the Province of British Columbia, this 6th day of February, 2014.
BY ORDER
