O R D E R
WHEREAS:
A. On July 13, 2012, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (Commission), pursuant to sections 45 to 46 of the Utilities Commission Act (Act), for a Certificate of Public Convenience and Necessity (CPCN) for constructing and operating a Liquefied Natural Gas (LNG) refueling station at the premises of Vedder Transport Ltd. (Vedder) located in Abbotsford, British Columbia and pursuant to sections 59-60 of the Act, for a rate design and rates established in the LNG Fueling Station Installation and Operation Agreement with Vedder for LNG Service (Permanent Refueling Agreement) as just and reasonable;
B. On October 5, 2012 the Commission issued Order C-11-12 (later amended by C-11-12A on June 11, 2013) approving, on an interim basis, the rate design and rates set out in Section 5 of the CPCN Application;
C. On December 20, 2013, the Commission approved by Order G-228-13 an Amending Agreement to the Fueling Station Agreement, which included the $1.50/GJ Host Fee payable to Vedder on a permanent basis effective December 12, 2013;
D. On February 7, 2014, FEI applied to the Commission for approval of FEI Tariff Supplement J-3, including the rate design and the rates established in the Fueling Station Agreement and subsequent Amending Agreements between Vedder and FEI on a permanent basis effective January 1, 2013;
E. The Commission reviewed and considered the Application and determines that the interim rates should be approved as permanent.
NOW THEREFORE pursuant to Sections 59-61 of the Utilities Commission Act, the Commission orders as follows:
1. The rate design and the rates established in the Liquefied Natural Gas (LNG) Fueling Station Installation and Operation Agreement and subsequent Amending Agreements with Vedder Transport Ltd. for LNG Service are approved on a permanent basis effective January 1, 2013.
2. The portions of FortisBC Energy Inc. Tariff Supplement J-3 which include the rate design and the rates established in the LNG Fueling Station Installation and Operation Agreement and subsequent Amending Agreements with Vedder Transport Ltd. for LNG Service are accepted.
3. The portion of the FEI Tariff Supplement J-3 which changes the Vedder LNG Fueling Station Agreement pursuant to Commission Order G-228-13 is accepted.
