O  R  D  E  R

WHEREAS:

 

A.      By Order E-15-12, dated May 25, 2012, the British Columbia Utilities Commission (Commission) accepted for filing by FortisBC Inc. (FortisBC) pursuant to section 71 of the Utilities Commission Act (UCA) a Capacity Purchase Agreement (WAX CAPA) between FortisBC and the Waneta Expansion Limited Partnership;

B.      On July 15, 2013, FortisBC and British Columbia Hydro and Power Authority (BC Hydro) entered into a Residual Capacity Agreement (RCA) effective from May 1, 2015 until September 30, 2025.  Pursuant to the RCA, FortisBC has agreed to sell to BC Hydro and BC Hydro has agreed to purchase certain of the surplus capacity associated with the WAX CAPA;

C.      On May 15, 2014, pursuant to sections 58 to 61 of the UCA, FortisBC filed an application with the Commission requesting approval of Rate Schedule 111 and Tariff Supplement No. 10 containing the RCA (Application);

D.      FortisBC has requested that the technical analysis of the RCA, filed as part of the Application, be held confidential due to its commercially sensitive nature;

E.       The “Practice Directive of the British Columbia Utilities Commission Confidential Filing” can be found on the Commission website under Guidelines & Resources;

F.       FortisBC also requested that the Application be considered and reviewed by the Commission without a public hearing process; and

G.     The Commission reviewed the Application and considers a public hearing process to hear the Application is in the public interest.

NOW THEREFORE the British Columbia Utilities Commission (Commission) orders as follows:

1.       In accordance with the Regulatory Timetable attached as Appendix A, the Commission seeks submissions from Interveners on:

a.       FortisBC Inc.’s (FortisBC) request for confidentiality of the Technical Analysis of the Residual Capacity Agreement pursuant to the “Practice Directive of the British Columbia Utilities Commission Confidential Filing”; and

b.      The appropriate regulatory process to review the Application.

2.       Interveners or Interested Parties should register with the Commission, in writing or electronic submission, by Wednesday, July 16, 2014.  Interveners should specifically state the nature of their interest in the Application and identify generally the nature of the issues that they may intend to pursue during the proceeding and the nature and extent of their anticipated involvement in the review process.

3.       FortisBC is to provide a copy of the Application to the Registered Interveners participating in the review of the FBC Application for Approval of a Multi-Year Performance Based Ratemaking Plan for 2014 through 2018 and the British Columbia Hydro and Power Authority Application for Approval of rates between BC Hydro and FortisBC Inc. with regards to Rate Schedule 3808, Tariff Supplement No. 3 Power Purchase and Associate Agreements, and Tariff Supplement No. 2 to Rate Schedule 3817.
