O R D E R
WHEREAS:
A. On August 5, 2014, Planet Energy (B.C.) Corp. (Planet Energy), applied to the British Columbia Utilities Commission (Commission) for renewal of its Gas Marketer Licence for the period November 1, 2014 to October 31, 2015 (Renewal Application);
B. On October 31, 2014, by Order A-14-14, the Commission found the Renewal Application did not include certain materials, pursuant to Sections 8 and 9 of the Licence Requirements. The Commission determined that renewal of Planet Energy’s Gas Marketer Licence, subject to certain conditions, including a prohibition on marketing to new and existing customers and/or enrolling and renewing new and existing customers, was warranted;
C. On November 21, 2014, Planet Energy applied to the Commission for: approval of its Training Materials and Renewal Package, required under Sections 8 and 9 of the Licence Requirements; and removal of condition “3.a”, prohibiting marketing and enrolling activity, from its Gas Marketer Licence (Application);
D. Commission staff and Planet Energy corresponded regarding the Application materials on December 4, 2014, December 16, 2014, December 23, 2014, December 24, 2014, January 13, 2015, January 22, 2015, January 27, 2015, February 3, 2015, February 11, 2015 and February 12, 2015;
E. On February 17, 2015, Planet Energy submitted an amended Application for the Commission’s review and approval; and
F. The Commission reviewed Planet Energy’s Application and relying upon the information and representations made by Planet Energy finds that approval of Planet Energy’s Training Materials and Renewal Package, as submitted on February 17, 2015, is warranted.
NOW THEREFORE pursuant to section 71.1(6) of the Utilities Commission Act, the British Columbia Utilities Commission orders as follows:
1. Planet Energy (B.C.) Corp.’s (Planet Energy) Training Materials and Renewal Package, as submitted on February 17, 2015, are approved.
2. Planet Energy’s prohibition on marketing to new and existing customers and/or enrolling and renewing new and existing customers as outlined in condition “3.a” is removed from Planet Energy’s Gas Marketer Licence effective the date of this order.
3. Planet Energy is prohibited from engaging in gas marketing activities under the Customer Choice program on Vancouver Island and in the Resort Municipality of Whistler.
