O  R  D  E  R

WHEREAS:

 

A.      On March 31, 2015, Tolko Industries Ltd. (Tolko) filed an application for exemption from Part 3 of the Utilities Commission Act (Act) in relation to Tolko’s proposed supply of electricity to Lavington Pellet Limited Partnership (LPLP) at a new wood pellet manufacturing facility adjacent to Tolko’s Lavington sawmill (Application);

B.      In the Application, Tolko requests that Appendix A - Tolko Services Agreement - be treated as confidential; and

C.      The Commission received the Application and finds that it is in the public interest to review the Application after receiving written comments from affected parties and the response to its information request on the Application.

 

NOW THEREFORE the British Columbia Utilities Commission orders as follows:

 

1.       The Application will be reviewed in accordance with the regulatory timetable as set out in Appendix A to this order.

2.       Tolko Industries Ltd.’s (Tolko) request that the Tolko Services Agreement, filed as Appendix A of the Application, be held confidential due to its commercially sensitive nature, is granted.

3.       Tolko must provide written notification of the Application with a copy of this order to British Columbia Hydro and Power Authority, Lavington Pellet Limited Partnership and any other potentially affected parties, and request that the affected parties submit their comments in writing, either in favour or opposed, directly to the Commission Secretary by Thursday, April 30, 2015.

4.    Tolko must provide written notification to British Columbia Hydro and Power Authority, Lavington Pellet Limited Partnership and any other potentially affected parties by Wednesday, April 22, 2015, and provide the Commission Secretary a copy of the notification sent to affected parties.
