Application for Approval of Operating Agreement between

the District of Logan Lake and FortisBC Energy Inc.

CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY

WHEREAS:

 

A.       A franchise agreement (Franchise Agreement) dated December 1, 1993, between FortisBC Energy Inc. (FEI) and the District of Logan Lake (Municipality), was set to expire on April 8, 2015;

 

B.       On April 8, 2015, FEI applied to the British Columbia Utilities Commission (Commission) for approval of an amending agreement to the Franchise Agreement between the Municipality and FEI (Amending Agreement);

 

C.       The Amending Agreement extended the terms and conditions of the Franchise Agreement to September 30, 2015. On April 23, 2015, Commission Order C-4-15 approved the Amending Agreement;

 

D.       On August 14, 2015, FEI and the Municipality signed a new operating agreement (Operating Agreement);

 

E.        On September 11, 2015, FEI filed an application requesting Commission approval, pursuant to section 45 of the Utilities Commission Act, of the executed Operating Agreement (Application); and

 

F.        The Commission reviewed the Application and considers that approval is warranted.

 

NOW THEREFORE pursuant to section 45 of the Utilities Commission Act, the British Columbia Utilities Commission approves the Operating Agreement as filed.
