Section 71 Filing of a Three-Year Baseload Gas Purchase Agreement

with Progress Energy Canada Ltd., effective November 1, 2015.

O  R  D  E  R

WHEREAS:

A.       By Letter L-28-15 dated July 9, 2015, the British Columbia Utilities Commission (Commission) accepted FortisBC Energy Inc.’s (FEI) 2015/16 Annual Gas Contracting Plan (ACP) as being in the public interest;

B.       On July 30, 2015, FEI filed with the Commission for acceptance under section 71 of the Utilities Commission Act (UCA) a Three-Year Baseload Gas Purchase Agreement with Progress Energy Canada Ltd. (Agreement);

C.       FEI requests that the details of the filing be kept confidential for reasons of commercial sensitivity;

D.       By Order G-130-06 dated October 27, 2006, the Commission approved the Rules for Natural Gas Energy Supply Contracts (Rules). The Rules are intended to facilitate the Commission’s review of natural gas energy supply contracts pursuant to section 71 of the UCA; and

E.        The Commission reviewed the filing and is satisfied that the Agreement is consistent with the ACP, is in the public interest and that the information in the filing should be kept confidential.

NOW THEREFORE pursuant to section 71 of the Utilities Commission Act and the British Columbia Utilities Commission’s Rules for Natural Gas Energy Supply Contracts, the Commission accepts the Three-Year Baseload Gas Purchase Agreement between FortisBC Energy Inc. and Progress Energy Canada Ltd. The Commission will keep the Agreement and information in the filing confidential on the basis that this information is commercially sensitive.
