O  R  D  E  R

WHEREAS:

A.      On April 17,2015, Creative Energy Vancouver Platforms Inc. (Creative Energy) applied to the British Columbia Utilities Commission (Commission) for an order approving a new neighbourhood energy agreement between Creative Energy and the City of Vancouver (CoV) under section 45(7) and granting a Certificate of Public Convenience and Necessity under section 45(9) of the Utilities Commission Act to construct and operate a new neighbourhood energy system to serve new developments in the Northeast False Creek and Chinatown neighbourhoods of the CoV (Application);

B.      On May 8, 2015, the Commission issued Order G-75-15 establishing a Regulatory Timetable for the review of the Application, which included a May 22, 2015 deadline for intervener registration and comment on the proposed one‐day streamlined review process to be held on Wednesday, June 24, 2015;

C.      The Commission received comments from five of the eleven registered interveners regarding the streamlined review process. FortisBC Alternative Energy Services Inc. opposed the streamlined review process, requesting that the Commission instead establish a more formal hearing process that allows for a more expansive public record;

D.      On May 25, 2015, Creative Energy requested the opportunity to respond to intervener comments regarding the streamline review process. The Commission reviewed the request and agreed that Creative Energy’s comments be submitted by Friday, May 29, 2015;

E.       On May 29, 2015, Creative Energy submitted its response to intervener comments. In its response, Creative Energy proposed a second round of information requests, an opportunity for interveners to file evidence, a round of information requests on intervener evidence and rebuttal evidence filed by Creative Energy. In addition Creative Energy requested an extension to its initial information request response date, from June 15, 2015 to June 29, 2015; and

F.       The Commission reviewed the intervener submissions and Creative Energy’s response and requests and has determined that the Regulatory Timetable should be amended to include a Procedural Conference to be held on Friday, July 10, 2015, to determine the remainder of process for review of the Application.

 

NOW THEREFORE the British Columbia Utilities Commission orders as follows:

 

1.       The Regulatory Timetable as set out in Order G-75-15 is amended and attached as Appendix A to this order.

 

2.       Creative Energy Vancouver Platforms Inc. must respond to Commission and intervener information requests no later than Monday, June 29, 2015.
