for Re-sale of Natural Gas

O R D E R
WHEREAS:
A. On April 13, 2015, Templeton DOC Limited Partnership (Templeton LP) filed an application for exemption from Part 3 of the Utilities Commission Act in relation to Templeton LP’s proposed re-sale of natural gas purchased by Templeton LP from FortisBC Energy Inc. (FortisBC), for certain tenants of the McArthur Glen Designer Regional Outlet Centre at Vancouver International Airport (Outlet Centre) (Application);
B. On May 15, 2015, Templeton LP submitted a letter requesting the Commission to temporarily suspend its consideration of the Application. This was to allow Templeton LP and FortisBC to carry out negotiations on a proposed arrangement for Templeton LP’s retail tenants at the new Outlet Centre to receive natural gas service directly from FortisBC;
C. On June 10, 2015, and again on July 3, 2015, Templeton LP submitted letters requesting the Commission to continue to suspend consideration of the Application pending the outcome of discussions between Templeton LP and FortisBC;
D. On July 7, 2015, Templeton LP submitted a letter advising the Commission that it was withdrawing the Application since negotiations between Templeton LP and FortisBC were still ongoing;
E. The Commission has reviewed Templeton LP’s July 7, 2015 letter, and is approving the request to withdraw the Application.
NOW THEREFORE pursuant to section 88.1 of the Utilities Commission Act, the Commission orders that Templeton DOC Limited Partnership’s application for an exemption pursuant to section 88(3) of the Utilities Commission Act for re-sale of natural gas is dismissed.
