ORDER

WHEREAS:

 

A.      By email notification dated May 12, 2016, the Western Electricity Coordinating Council (WECC) recommended dismissal of the following Confirmed Violations for Tolko Industries Limited (Tolko):

B.      Order G-123-09 approved the Compliance Monitoring Program (CMP), which provides a process for dealing with violations of Mandatory Reliability Standards (MRS) adopted by the British Columbia Utilities Commission (Commission) and Order R-34-15 approved revisions and updates to the CMP;

C.      On April 14, 2014, WECC, acting as the Commission’s MRS Administrator, issued a Notice of Alleged Violation (NOAV) to Tolko for the alleged violations of the reliability standards noted above. Tolko chose not to submit a formal response to the NOAV and instead informed WECC and the Commission that it was preparing Mitigation Plans for the Alleged Violations;

D.      By Commission Order R-16-14, dated May 22, 2014, the Commission confirmed the Alleged Violations noted above;

E.       During a subsequent review of Tolko’s Undervoltage Load Shedding (UVLS) equipment, WECC assessed that the purpose of Tolko’s UVLS equipment is solely to provide protection for Tolko’s own system infrastructure and equipment by taking it offline during an undervoltage event. As such, the UVLS equipment is not applicable to a UVLS program as described in reliability standard PRC-011-0; and

F.       The Commission reviewed WECC’s recommendation and considers dismissing the Confirmed Violations and rescinding Order R-16-14 is warranted.

 

NOW THEREFORE pursuant to section 125.2(10) of the Utilities Commission Act and in accordance with the Compliance Monitoring Program, the British Columbia Utilities Commission dismisses the Confirmed Violations identified above and rescinds Commission Order R-16-14.
