ORDER

WHEREAS:

A.      On April 1, 2016, pursuant to sections 59 to 61, 89 and 90 of the Utilities Commission Act (UCA), Creative Energy Vancouver Platforms Inc. (Creative Energy) filed with the British Columbia Utilities Commission (Commission) its 2016-2017 Revenue Requirements Application (RRA) for steam service, a rate design and RRA for Northeast False Creek (NEFC) hot water service (Application);

B.      Creative Energy proposed the Application be heard through a written process that includes one round of information requests, a second if necessary and written arguments;

C.      On April 12, 2016, the Commission issued Order G-49-16 which, among other things, established a preliminary regulatory timetable attached as Appendix A to that order, which provided for one round of information requests and submissions on further process and a proposed regulatory timetable attached as Appendix B to that order. The proposed regulatory timetable included dates for a second round of information requests, followed by written arguments;

D.      The regulatory timetable was amended by Order G-66-16 on May 12, 2016 and Order G-70-16 on May 18, 2016. Appendix B to Order G-70-16 contains a revision to the proposed regulatory timetable for comment;

E.       On June 9, 2016, the Commission received comments from the BC Sustainable Energy Association and Sierra Club of BC, the British Columbia Old Age Pensioners’ Organization, Active Support Against Poverty, and Council of Senior Citizens’ Organization, the Commercial Energy Consumers Association of British Columbia (CEC), Fortis BC Energy Inc. and FortisBC Alternative Energy Services Inc. (FAES), all of whom either support or do not object to the proposed process and regulatory timetable set out in Appendix B to Order G-70-16;


 

 

F.       In its comments (entered as Exhibit C5-3), FAES states it has no objection to the proposed regulatory timetable providing the Commission incorporates into the evidentiary record certain portions of evidence from the FAES Application for Rate Design and Rates Established in Agreements for Thermal Energy Services for the TELUS Garden Development proceeding, attached as Appendix A to its comment letter;

 

G.     On June 13, 2016, Creative Energy replied to the intervener comments, submitting it does not object to incorporating into the record of this proceeding Appendix A to the FAES comment letter and summarized that all interveners and Creative Energy either support or do not object to the proposed process and regulatory timetable;

 

H.      On June 14, 2016, CEC submitted a letter to the Commission stating that it has reviewed FAES’s request and Creative Energy’s response and does not oppose the inclusion of Appendix A to FAES’s comment letter into the record of this proceeding; and

 

I.        The Commission has reviewed the submissions and determines that the proposed process and regulatory timetable should be approved.

 

NOW THEREFORE in accordance with section 59 to 61 of the Utilities Commission Act the British Columbia Utilities Commission orders as follows:

 

1.       The Regulatory Timetable attached as Appendix A to this order is approved.

 

2.       The evidence set out in Appendix A to Exhibit C5-3 will form part of the evidentiary record of this proceeding. For ease of reference the Commission requests FortisBC Alternative Energy Services Inc. to file the evidence as a standalone exhibit no later than Wednesday June 22, 2016.

 

3.       Creative Energy Vancouver Platforms Inc. must file by no later than Tuesday, June 21, 2016, an update of its Application by consolidating the original Application (Exhibit B-1), the errata to the Application (Exhibit B‑1‑9), and the most recent version of the appendices to the Application.
