ORDER

 

WHEREAS:

 

A.      On June 23, 2016, British Columbia Hydro and Power Authority (BC Hydro) filed an application with the British Columbia Utilities Commission (Commission) for approval of two new supplements: Electric Tariff Supplements No. 91 (Electricity Supply Agreement) and 92 (Load Interconnection Agreement) and approval of amendments to Rate Schedules 1823, 1825, 1827 and 1852 (the Application). The Application was made pursuant to Order in Council No. 397 dated June 9, 2016, and the Direction to the Commission Respecting Liquefied Natural Gas Customers (Direction);

B.      The Direction was issued by the Lieutenant Governor in Council and provides direction to the Commission with respect to implementing the British Columbia Government’s policy related to the provision of electricity service to FortisBC Energy Inc.’s Tilbury liquid natural gas (LNG) facility;

C.      Section 3(1) of the Direction requires the Commission, within 10 days of the date of this Application, to issue an order to set as a rate:

                  (i)            the agreement, dated March 30, 2015, entitled “Electricity Supply Agreement” between BC Hydro and FortisBC Energy Inc.;

                (ii)            the agreement, dated March 30, 2015, entitled “Load Interconnection Agreement” between BC Hydro and FortisBC Energy Inc.;

 

D.      Section 3(3) of the Direction requires that the Commission, as soon as practicable, issue an order so that BC Hydro amends Rate Schedules 1823, 1825, 1827 and 1852 to include the following provision:

Transmission service, within the meaning of the Direction Respecting Liquefied Natural Gas Customers, may not be provided under this rate schedule”;

 

E.       BC Hydro has developed Tariff Supplements No. 91 and 92, included in Attachments A and B of the Application, for the provision of electricity service to FortisBC Energy Inc.’s Tilbury LNG Facility. The Application states that Tariff Supplements No. 91 and 92 fulfill the requirements specified in section 3(1) of the Direction;

F.       BC Hydro has amended Rate Schedules 1823, 1825, 1827 and 1852, included in Attachment C, in accordance with section 3(3) of the Direction;

G.     BC Hydro requests that the confidential information in Attachments A and B be held confidential pursuant to the Commission’s Confidential Filing Practice Directive and section 42 of the Administrative Tribunals Act. BC Hydro states that Attachments A and B of the Application contain confidential information that relates to commercially sensitive information and public disclosure may prejudice BC Hydro’s position in other negotiations with LNG proponents. Accordingly, BC Hydro has filed a redacted public version of the Application;

H.      Terms used in this order have the meanings given to them in the Direction where applicable; and

I.        The Commission considered the Application and the Direction and determined that approval is warranted.

 

NOW THEREFORE the British Columbia Utilities Commission orders as follows:

 

1.       Pursuant to the Direction to the British Columbia Utilities Commission Respecting Liquefied Natural Gas Customers issued under section 3 of the Utilities Commission Act, the Commission:

a.       Approves Tariff Supplement No. 91 (Electricity Supply Agreement) and Tariff Supplement No. 92 (Load Interconnection Agreement) between British Columbia Hydro and Power Authority and FortisBC Energy Inc., included as Attachments A and B in the Application, effective July 4, 2016.

b.      Approves amended Rate Schedules 1823, 1825, 1827 and 1852, filed as Attachment C in the Application, effective July 4, 2016.

 

2.       Pursuant to the Commission’s Rules of Practice and Procedure and section 42 of the Administrative Tribunals Act, the Commission will hold confidential Attachments A and B of the Application as requested by British Columbia Hydro and Power Authority as they contain commercially sensitive information.
