ORDER
WHEREAS:
A. On May 24, 2016, Shannon Wall Centre Rental Apartments Limited Partnership (SWCRA) filed an application (Application) for rates under sections 59-61 and 89 and 90 of the Utilities Commission Act (UCA) for the Shannon Estates Thermal Energy System (SETES);
B. The SETES is to provide space heating, space cooling and domestic hot water to approximately 600 residential customers and to up to two commercial customers in the two phased development called Shannon Mews & Apartments located at 7199 Granville Street, Vancouver, BC;
C. The Application requests, among other things, approval for the terms and conditions and rates as set out in Appendix A to the Application;
D.
On June 1, 2016, the Commission issued Order
G-77-16A which established a regulatory timetable for the written review of the
Application and granted interim relief to invoice customers effective June 1,
2016, on
a refundable basis pending a final determination;
E. In accordance with the regulatory timetable established by Order G-77-16A, SETES filed its reply submission on July 15, 2016, including a request to hold certain portions of the reply submission confidential;
F. SETES states on page 1 of its reply submission “We offer [as part of our reply submission] additional information to support our rates application.” As such SETES’s reply submission, including the confidential portion, introduced a significant amount of new evidence; and
G. The Commission finds benefit in the new evidence forming part of the evidentiary record and therefore finds that reopening the evidentiary phase of the proceeding in a limited scope is warranted.
NOW THEREFORE the British Columbia Utilities Commission orders as follows:
1. SETES’s request to hold certain portions of its reply submission filed on July 15, 2016 confidential is approved for the reasons set out by SETES in its request; however, SETES must file a public redacted version of its confidential reply submission no later than Tuesday, July 26, 2016.
2. The evidentiary record for the review of the Shannon Estates Thermal Energy Rates (SETES) Application is reopened and the written hearing process will proceed in accordance with the Regulatory Timetable attached as Appendix A to this order.
3. The additional information in SETES’s reply submission filed on July 15, 2016 and the public redacted version to be filed on July 26, 2016, in accordance with directive 1, will form part of the evidentiary record (Reply Submission).
4. The scope of Information Request (IR) No. 2 is limited to the SETES Reply Submission and questions seeking clarification of SETES’s responses to IR No. 1.
5. SETES’s responses to the Intervener’s IR No. 2 must be made in the same full and adequate manner as the responses provided to the British Columbia Utilities Commission’s IRs.
