ORDER

WHEREAS:

 

A.      By notification dated September 22, 2016, the Western Electricity Coordinating Council (WECC) recommended dismissal of the following Mitigation Plans for Tolko Industries Limited (Tolko):

B.      Order G-123-09 approved the Compliance Monitoring Program (CMP), which provides a process for dealing with violations of Mandatory Reliability Standards (MRS) adopted by the British Columbia Utilities Commission (Commission) and Order R-34-15 approved revisions and updates to the CMP;

C.      In accordance with the Administrative Agreement between WECC and the Commission approved by Commission Order G-123-09 and renewed on August 21, 2014, WECC makes recommendations to the Commission regarding, among other things, the acceptance of Mitigation Plans (MPs);

D.      By Commission Order G-150-10, dated October 7, 2010, the Commission accepted the MPs for the Possible Violations noted above, and on July 2, 2015, Tolko submitted Attestations of Mitigation Plan Completion for these MPs;

E.       In consideration of various factors including the elapsed time, on September 8, 2016, Tolko submitted new Self-Reports to address these issues of non-compliance under the currently enforceable Reliability Standards PRC-005-1.1b R1 and R2. WECC assigned new tracking numbers to these Self-Reports: BCUC2016000595 and BCUC2016000596 respectively;

F.       On September 22, 2016, WECC issued a Notice of Consolidation of Possible Violations and Recommendation of Dismissal of Mitigation Plans (Recommendation), informing the Commission that WECC has consolidated the issues reported under BCUC201000056 and BCUC201000057 within the scope of BCUC2016000595 and BCUC2016000596 and that to alleviate confusion, WECC recommends that the Commission dismiss the MPs for the original Possible Violations noted above; and

G.     The Commission reviewed WECC’s recommendation and considers dismissing the MPs is warranted.

 

NOW THEREFORE pursuant to section 125.2(10) of the Utilities Commission Act and in accordance with the Compliance Monitoring Program, the British Columbia Utilities Commission dismisses the Mitigation Plans for the Possible Violations BCUC201000056 and BCUC201000057 as approved by Order G-150-10, dated October 7, 2010.
