ORDER
WHEREAS:
A. On June 6, 2016, pursuant to section 71 of the Utilities Commission Act and section 6.0 of the Commission’s Rules for Natural Gas Energy Supply contracts, FortisBC Energy Inc. (FEI) filed with the British Columbia Utilities Commission (Commission) for acceptance the baseload and seasonal gas purchase agreements for FEI’s Commodity and Midstream portfolios that have been transacted for the period November 1, 2016 to October 31, 2019 including applicable market factors (Filing);
B. By Letter L-43-15 dated December 3, 2015, the Commission accepted the FEI Amendment to the 2015/16 Annual Contracting Plan (2015/16 ACP Amendment);
C. FEI requests that the Filing and associated documents remain confidential due to their commercially sensitive nature; and
D. The Commission reviewed the Filing and is satisfied that the contracts are consistent with the 2015/16 ACP Amendment, the market factors are appropriate considering market prices at the time they were negotiated and the contracts are in the public interest.
NOW THEREFORE pursuant to section 71 of the Utilities Commission Act and the British Columbia Utilities Commission’s Rules for Natural Gas Energy Supply Contracts, the Commission accepts the natural gas contracts shown in Attachment A to this order. The Commission will keep the Filing and associated documents confidential as requested by FortisBC Energy Inc. as they contain commercially sensitive information.
