Registration of Stream A Thermal Energy Systems Projects

ORDER

WHEREAS:

 

A.      On November 4, 2016, Axsiom GeoEnergy (Richmond) Corporation (Axsiom) filed with the British Columbia Utilities Commission (Commission) an application to register the following Stream A Thermal Energy Systems (TES) projects (Application) in accordance with the TES Regulatory Framework Guidelines (TES Guidelines) Requirements:

1      The Pier - 6160 London Road, Richmond, BC  V7E 3S3; in service date in September 2019;

2)      Parc Riviera- 10197 River Drive, Richmond, BC  V6X 3K0; in service before August 28, 2014, without a certificate of public convenience and necessity and where no previous exemption was granted, and that would not otherwise qualify for a Micro TES exemption;

B.      By Order G-127-14 dated August 28, 2014, the Commission approved the TES Guidelines;

C.      Under section 2.1 of the TES Guidelines, a Stream A TES is defined as: An On-Site TES with an Initial Capital Cost above $500,000 but less than $15,000,000 is exempt from sections 44.1, 45 and 59-61 of the UCA. TES Providers are required to register Stream A TES prior to building or otherwise acquiring the Stream A TES;

D.      In section 2.5 of the TES Guidelines, it states: A TES that would not otherwise qualify for exemption as either a Micro TES or a Strata Corporation TES that was in-service before August 28, 2014, and for which no previous CPCN exemption was granted, must file a Stream A registration form with the Commission;

E.       The Commission has reviewed the Application and is satisfied that the TES projects meet the characteristics of a Stream A TES and are suitable for exemption from sections 44.1, 45 and 59-61 of the Utilities Commission Act


 

NOW THEREFORE pursuant to sections 88(3) of the Utilities Commission Act, and by the advance approval of the Lieutenant Governor in Council (OIC 400), the British Columbia Utilities Commission orders as follows:

 

1.      In accordance with the Thermal Energy Systems (TES) Regulatory Framework Guidelines (TES Guidelines) the following TES projects are exempted from sections 44.1, 45 and 59-61 of the Utilities Commission Act:

                                            I.            The Pier - 6160 London Road, Richmond, BC  V7E 3S3; and

                                          II.            Parc Riviera - 10197 River Drive, Richmond, BC  V6X 3K0.

 

2.      Axsiom GeoEnergy (Richmond) Corporation must file with the British Columbia Utilities Commission an annual report for each project in accordance with Stream A annual reporting guidelines as provided in Appendix B of the TES Guidelines, with the first report to be filed on or before February 15, 2017.
