CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY
WHEREAS:
A. Superior Propane is a division of Superior Plus Limited Partnership which is a subsidiary of Superior Plus Corporation (Superior Propane);
B. Following a public proceeding, on November 28, 2016, by Order G-172-16, the British Columbia Utilities Commission (Commission) approved the Superior Propane gaseous propane tariff and permanent rates for the Seascapes Development (Seascapes) pursuant to sections 59 to 61 of the Utilities Commission Act (UCA);
C. On August 7, 2015, by Order G-133-15, the Commission determined that Superior Propane meets the definition of a public utility under section 1 of the UCA for its gaseous propane grid operations at the Seascapes Development, located in West Vancouver, British Columbia;
D. Superior Propane’s Seascapes gaseous propane grid was installed and operating after September 11, 1980, and is currently providing gaseous propane to customers at Seascapes;
E. Section 45 of the UCA requires that, after September 11, 1980, a person must not begin the construction or operation of a public utility plant or system, or an extension of either, without first obtaining from the Commission a certificate of public convenience and necessity (CPCN);
F. Section 46(2) of the UCA states that the Commission has discretion whether to hold a hearing; and
G. Based on submissions and evidence filed in the above public proceedings, the Commission determines that a CPCN for Superior Propane’s Seascapes gaseous propane grid is required and that granting a CPCN is in the public interest.
NOW THEREFORE pursuant to sections 82, 45 and 46 of the Utilities Commission Act, the British Columbia Utilities Commission grants a certificate of public convenience and necessity to Superior Propane, a division of Superior Plus Limited Partnership, for the Seascapes Development gaseous propane grid.
