Filing of Propane Supply Agreement with Superior Gas Liquids

ORDER

WHEREAS:

 

A.      On April 24, 2017, Superior Propane filed its compliance filing in compliance with directives contained in Order G-172-16, including a copy of the propane supply agreement (titled “Sales Agreement” in the filing) between Superior Propane and Superior Gas Liquids (SGL) effective April 1, 2017 to March 31, 2018 (Supply Agreement);

B.      On May 19, 2017, Superior Propane requested to keep the Supply Agreement confidential as it contains commercially sensitive information;

C.      On October 26, 2006, the British Columbia Utilities Commission (Commission) issued Order G-130-06 which set out the Commission’s Rules for Natural Gas Energy Supply Contracts as Appendix A to the order;

D.      By Order G-133-15, the Commission ordered that Superior Propane is a public utility as defined in section 1 of the Utilities Commission Act (UCA) and is therefore providing a regulated service of delivering and selling gaseous propane to the strata development property at Seascapes; and

E.       By Order G-172-16, the Commission found Order G-133-15 determined that Superior Propane is a public utility, and therefore any energy supply contract entered into by Superior Propane to purchase propane is subject to the Commission’s review under section 71 of the UCA. Also, the Commission accepted the supply agreement with Superior Gas Liquids filed in the Superior Propane Rates Application to be in accordance with section 71 of the UCA. Superior Propane was directed to file a copy of the supply agreement under section 71 of the UCA for its propane purchase whenever a change or renewal to the accepted agreement occurs.

 

NOW THEREFORE pursuant to section 71 of the Utilities Commission Act, the British Columbia Utilities Commission accepts the Supply Agreement effective April 1, 2017 to March 31, 2018, between Superior Propane and Superior Gas Liquids. The Commission will keep the Supply Agreement confidential due to its commercially sensitive nature.
