ORDER
WHEREAS:
A. On November 9, 2017, British Columbia Hydro and Power Authority (BC Hydro) submitted an application seeking approval of changes to Attachments A-1 and B-1 of the Open Access Transmission Tariff (OATT). The proposed amendments include merging Attachments A-1 and B-1 and adopting a single Attachment B-1 to govern all forms of point-to-point transmission service making it consistent with the Federal Energy Regulatory Commission (FERC) pro forma OATT;
B. On November 21, 2008, the British Columbia Transmission Corporation (BCTC) submitted an application to amend the OATT, including amendments to the provisions for the sale or assignment of transmission services (Capacity Reassignment) that are contained in section 23 of the OATT, and proposed forms of service agreement for the resale, reassignment or transfer of short‑term firm and long‑term firm point‑to‑point transmission service (Reassignment Agreements) as Attachments A‑1 and B‑1;
C. Commission Order G-102-09, dated September 10, 2009 approved the Capacity Reassignment provisions and the Reassignment Agreements;
D. In its subsequent compliance filing dated October 21, 2009, BCTC filed its OATT tariff pages for endorsement, with the exception of certain listed items including the Capacity Reassignment provisions and the Reassignment Agreements that required additional time to finalize business practices and/or make the necessary system upgrades;
E. On November 16, 2010, BC Hydro made a further compliance filing, which included submission of OATT tariff pages for endorsement related to the Capacity Reassignment provisions of section 23 of the OATT; however, the Reassignment Agreements were not included in this filing due to an administrative error;
F. BC Hydro states that despite not using the Reassignment Agreements based on the FERC pro forma OATT, it has engaged in open and transparent reassignment processes and has ensured that it has a contractual relationship with assignees; and
G. The Commission reviewed the Application and finds that approval is warranted.
NOW THEREFORE pursuant to sections 58 through 61 of the Utilities Commission Act, the Commission orders as follows:
1. The amendments to the OATT as described in BC Hydro’s Application dated November 9, 2017, are approved.
2. BC Hydro must notify Transmission Customers affected by this order by way of a transmission bulletin posted to its transmission website within 15 days of the date of this order.
3. BC Hydro must file amended OATT Tariff pages for endorsement, in accordance with the terms of this order within 30 days of the date of this order.
