ORDER
WHEREAS:
A. On December 12, 2017, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (Commission), pursuant to sections 59 to 61 and 89 of the Utilities Commission Act (UCA), for approval of the rates established in the fueling services agreement between FEI and Ledcor LNG Group Ltd. (Ledcor) (Ledcor-Cool Creek Agreement) on an interim and permanent basis, effective January 3, 2018 (Application);
B. On December 12, 2017, FEI and Ledcor entered into the Ledcor-Cool Creek Agreement, which established the terms, conditions and rates for Ledcor to receive LNG fueling service from the LNG station located at Cool Creek Energy Ltd. in Kamloops, British Columbia;
C. On December 15, 2017, Order G-189-17 approved the rates established in the Ledcor-Cool Creek Agreement on an interim basis, effective January 3, 2018;
D. On January 5, 2018, Commission Staff issued questions to FEI, and FEI responded on January 17, 2018; and
E. The Commission has now completed its review of the Application and determines that rates should be approved on a permanent basis.
NOW THEREFORE pursuant to sections 59 to 61 of the UCA, the Commission orders as follows:
1. The rates established in the Ledcor-Cool Creek Agreement are approved on permanent basis, effective January 3, 2018.
2. FEI is to file the Ledcor-Cool Creek Agreement in tariff supplement form for endorsement by the Commission within 30 days of the date of this order.
