Application for an Order in Relation to Changes to the Claim-Rated Scale

ORDER

WHEREAS:

 

A.      On March 2, 2017, the Lieutenant Governor in Council approved Order in Council 106 (OIC 106/17), which amended Special Direction IC2 to the British Columbia Utilities Commission, BC Regulation 307/2004, (Special Direction IC2), directing under paragraph (l) of section 3 (1) that the British Columbia Utilities Commission (Commission) approve and set rates in relation to the changes to the Claim-Rated Scale (CRS), within 20 days of the Insurance Corporation of British Columbia (ICBC) applying for approval of the changes to rates in accordance with a government directive;

B.      By Order G-35-17 dated March 16, 2017, the Commission approved, as directed under OIC 106/17, the Tariff page amendment with respect to the changes to the CRS, effective May 6, 2018, as set out in Attachment A to that Order;

C.      On March 1, 2018, the Lieutenant Governor in Council approved Order in Council 074 (OIC 074/18) amending Special Direction IC2, to direct the Commission, within 10 days of ICBC applying in accordance with a government directive for approval to not implement the changes to rates in relation to the changes to the CRS, to approve and set rates that do not include the changes set out in paragraph (l) of section 3 (1) of Special Direction IC2;

D.      On March 1, 2018, the Lieutenant Governor in Council approved Order in Council 073 (OIC 073/18), approving the Government Directive to ICBC dated February 13, 2018 which directs ICBC to make changes to the CRS by not implementing the changes that were to take effect on May 6, 2018;

E.       On March 1, 2018, ICBC filed an application pursuant to OIC 073/18 seeking a Commission order to not implement the changes to the CRS that were to take effect on May 6, 2018, so that the Tariff page currently in effect remains in the form as attached to the Government Directive (Application); and

F.       The Commission reviewed the Application to ensure that it is consistent with the requirements of
OIC 074/18 as directed and therefore finds that Commission approval is required.

 

NOW THEREFORE the Commission orders as follows:

 

1.    Pursuant to OIC 074/18 and section 99 of the Utilities Commission Act, the Application is approved and Order G-35-17 is rescinded.

2.    Rates that do not include the changes set out in paragraph (l) of section 3(1) of Special Direction IC2 continue to take effect as required by OIC 074/18.
