A Filing for Acceptance of a Propane Supply Agreement with

Superior Gas Liquids, a division of Superior Gas Liquids Partnerships

through FortisBC Alternative Energy Services Inc.

ORDER

WHEREAS:

A.      On March 29, 2018, Sun Peaks Utilities Co., Ltd. (SPUCL), acting on behalf of Resort Gas Ltd. (RGL), filed with the British Columbia Utilities Commission (BCUC) for acceptance a propane supply agreement dated March 1, 2018, between Superior Gas Liquids, a division of Superior Gas Liquids Partnerships (Superior), and FortisBC Alternative Energy Services Inc. (FAES) to supply SPUCL with propane for the period from April 1, 2018 to March 31, 2020 (Agreement);

B.      SPUCL contracted with DESCO Distributed Energy Services Co. Ltd. (now known as FAES) to provide propane vapour distribution technical services, propane supply, and propane storage and vaporization facilities to service the resort community at Sun Peaks as noted in Order C-11-98, dated June 25, 1998;

C.      By Order E-6-16, dated April 14, 2016, the Commission accepted a propane supply agreement between Superior and FAES to supply SPUCL with propane for the period from April 1, 2016 to March 31, 2018;

D.      By Order G-161-17, dated October 24, 2017, the BCUC approved the sale to RGL of all the assets and liabilities relating to the gas utility operated by SPUCL. RGL will contract with SPUCL to operate the gas utility on its behalf;

E.       SPUCL requests that the filing including the Agreement remain confidential due to its commercially sensitive nature; and

F.       The BCUC reviewed the filing and is satisfied that the Agreement is in the public interest.

NOW THEREFORE pursuant to section 71 of the Utilities Commission Act and the British Columbia Utilities Commission’s Rules for Natural Gas Energy Supply Contracts, the BCUC accepts for filing the executed copy of the Propane Supply Agreement between FAES and Superior for the supply of propane to SPUCL. The BCUC will keep the filing including the Agreement confidential as requested by SPUCL due to its commercially sensitive nature.
