ORDER
WHEREAS:
A. On April 26, 2018, FortisBC Energy Inc. (FEI) applied for interim and permanent approval of the rates for service established in the 2018 Vedder Fueling Agreement, effective May 1, 2018 (Application);
B. On December 13, 2013, FortisBC Energy Inc. (FEI) and Arrow Transportation Systems Inc. (Arrow) entered into a Mobile Re-Fueling Equipment Agreement (Arrow Agreement) that established the terms and conditions for FEI’s provision of the Liquefied Natural Gas (LNG) fueling service to Arrow from a fueling station on Arrow’s premises (Arrow Fueling Station);
C. On January 14, 2015, FEI and Vedder Transport Ltd. (Vedder) executed an LNG Fueling Services Agreement whereby Vedder would be permitted to receive LNG from the Arrow Fueling Station (2015 Vedder Fueling Agreement);
D. On February 6, 2015, FEI applied for interim and permanent approval of the rates for service established in the 2015 Vedder Fueling Agreement, effective January 14, 2015;
E. On February 12, 2015, the BCUC issued Order G-19-15, pursuant to sections 59 to 61 and 89 of the Utilities Commission Act (UCA), approving the rates and contracts for LNG Supply from the Arrow Fueling Station for Vedder on an interim basis, effective January 14, 2015;
F. On March 18, 2015, the BCUC issued Order G-43-15, pursuant to sections 59 to 61 of the UCA, approving the rates and contracts for LNG Supply from the Arrow Fueling Station for Vedder on a permanent basis, effective January 14, 2015;
G. By Order G-85-18 on May 1, 2018, the BCUC approved permanent rates for the Application;
H. On May 2, 2018, errors were identified in Order G-85-18; and
I. The BCUC has reviewed the order and considers that BCUC Order G-85-18 should be rescinded.
NOW THEREFORE pursuant to sections 59 to 61 and 99 of the Utilities Commission Act, the BCUC orders as follows:
1. Order G-85-18 is rescinded and replaced by this order.
2. The rates and agreement for LNG Supply from the Arrow Fueling Station for Vedder in the 2018 Vedder Fueling Agreement are approved on a permanent basis, effective May 1, 2018.
3. FortisBC Energy Inc. is to file the 2018 Vedder Fueling Agreement in tariff supplement form within 30 days of the date of this order.
